CargoTrust platform terms of use

These terms govern access to and use of the CargoTrust website, administrative environment and mobile application (hereinafter: the Platform). The operator is CargoTrust for customer support purposes, unless otherwise published. By registering, installing the app or continuing to use the service you confirm that you have read and accepted these terms, the Privacy Policy available at /privacy and any supplements the Operator publishes. The platform is a company registry and a freight board.

1. Acceptance and amendments

By using the Platform you enter into a legal agreement with the Operator. If you do not accept these terms, you must stop using the service. CargoTrust may amend the terms; an updated version will be published on the website. Continued use after amendments take effect is deemed acceptance. For material changes to data processing we may request additional confirmation where required by law.

2. Definitions

User: a legal or natural person accessing the Platform on behalf of an organisation. Organisation: a business entity registered in the system. Review: a user entry about collaboration experience between organisations, with role context. Proof of collaboration: a file the User attaches to confirm actual business interaction. Content: texts, documents, comments, reports and other data Users enter. A load is a listing for carriage from pickup to delivery. The freight board is the part of the Platform for posting loads, watches, and suggestions. The deal on a load is made outside the Platform.

3. Role of the Platform (no dispute mediation)

CargoTrust is solely a technical intermediary that enables sharing of experiences and reputation signals in transport and logistics, and posting of listings on the freight board. We are not a party to your contracts of carriage, forwarding, brokerage or payment. We do not decide the truth of claims, do not score service quality on behalf of third parties and do not represent any side. Cooperation evidence only helps establish that an interaction likely existed, not that every statement in the text is proven. Users alone bear the risk of business decisions based on Platform content. The same applies to the freight board: CargoTrust is not a carrier, forwarder or shipper, does not take part in negotiations and does not charge a commission on haulage price. Contact is the number on the listing; the deal is a call, WhatsApp or Viber, outside the app.

4. Freight board

The freight board is part of the Platform, together with the company registry. A user may post a load or a free truck, save a watch for a place and radius and get a notification when a load falls inside that circle, and see suggestions tied to a free truck. A load or truck offer is a listing, not a carriage contract. CargoTrust is not a contracting party, does not set or broker price, does not charge a commission on the agreed haulage, and does not guarantee that a deal will be made or performed. The contact on the listing is provided by the poster; the deal (call, WhatsApp or Viber) happens outside the app. A listing from an outside source is not from a registered company and carries a warning. A confirmed company ID label (JIB, PIB, OIB) or organisation status is not a warranty of identity, quality, payment or performance. Before agreeing, the user checks the other party (registration, licences, insurance, references). The poster is responsible for the accuracy of the route, date, vehicle, cargo and phone number, and for keeping the offer real and removing it when it no longer applies. False, stale or misleading offers are forbidden, as are offers to haul goods whose trade is prohibited. You may report a suspicious listing; the Operator may remove content or restrict an account.

5. Terms of use and accounts

Access to publishing reviews and certain features is available to an organisation that has completed registration and company ID confirmation in accordance with Operator rules. The User warrants accuracy of organisation data and full authority to act on its behalf. The Platform may only be used by adults (18 or older) whom the organisation has authorised to act on its behalf. Each account must be protected with a strong password; the User is responsible for activities carried out through their access. Sharing accounts with unauthorised persons is not permitted.

6. Company ID confirmation and responsibility

A label such as "JIB confirmed", "PIB confirmed" or "OIB confirmed" means only that the organisation uploaded a registration document and that the identification number in it matches the one entered on the Platform. The Operator does not check the identity of the people using the account and does not guarantee that the account is really run by the company that number belongs to, or that the person is authorised to act on its behalf. Registration documents are often public, so someone who is not that company can upload them too. The label does not confirm identity, reliability, solvency or service quality. For every deal, on the board, in messages or outside the Platform, the User checks the other party themselves (for example by calling the number from the public register, a contract, licences, insurance) and bears sole responsibility and risk for the cooperation. The Operator is not liable for damage caused by someone falsely presenting themselves as another company. If you suspect someone is presenting themselves as your company, report it to the contact in these terms; the Operator may temporarily remove the label or restrict the account until the matter is cleared up.

7. User content and liability

You and your organisation are solely responsible for all content you enter under applicable laws on material and non-material damage, defamation, trade secrets, personal data protection and unfair competition. False evidence, document forgery, harassment, hate speech, unfounded defamation you cannot prove, and publication of third-party personal data without legal basis are prohibited. You confirm you have the right to share attached documents in terms of trade secrets and contracts with counterparties.

8. Evidence, AI and moderation

The Platform may use automated tools (including AI) to verify content, extract data from documents and detect offensive or inappropriate content. An administrator may temporarily or permanently remove content, hide posts or restrict an account if they assess a breach of rules or legal requirements. Such measures do not constitute a legal judgment on a dispute between companies.

9. Prohibited conduct

Prohibited: breaching security or attempting unauthorised access; harvesting other users’ data with bots for purposes outside allowed Platform use; sharing access tokens; exporting the database for commercial use outside the Platform; spam and intrusive messaging; posting false, stale or misleading loads and truck offers; using another’s identity or contacts without authority; offering haulage of goods whose trade is banned or restricted; any use that threatens service stability.

10. Intellectual property rights

Software code, design and the CargoTrust brand remain the Operator's property. The User retains rights to content they create, but grants the Operator a non-exclusive, royalty-free, worldwide licence to host, reproduce, publicly display and process that content for providing, protecting and improving the Platform.

11. Data privacy

Processing of personal and business data is governed by the Privacy Policy at /privacy. By using the service you confirm you are familiar with data categories, legal bases and rights you have under GDPR and local laws. If you turn on Remember me at sign-in, your email and password stay only in the protected storage of that phone and are not sent to our servers. You can turn the option off, and they are then deleted from the device.

12. Disclaimer of warranties

The Platform is provided as is and as available, without express or implied warranties, including fitness for a particular purpose or uninterrupted operation. CargoTrust does not warrant that content (including loads, truck offers, reviews and contacts) is accurate, complete or current, or that the other party will perform a deal made outside the Platform.

13. Limitation of liability

To the fullest extent permitted by applicable law, CargoTrust, its owners and partners are not liable for indirect damage, lost profit, business interruption, reputational harm, loss or damage to goods, non-payment for haulage, fraud or disputes between Users, or for consequences of relying on third-party content or outside listing sources. Total liability to you under these terms (if any arises) is limited to the amount you paid the Operator in the last twelve months, except where law does not permit such limitation.

14. Indemnification obligation

You agree to defend and indemnify CargoTrust against all claims, legal costs and damages arising from your breach of these terms, misuse of the Platform or content you publish.

15. Suspension and termination

CargoTrust may suspend an account if there is reasonable suspicion of a law breach or a security threat. A person can erase their login in the app by confirming their password. That removes the email, phone, password, session, and push token. The company is not deleted from the registry. Reviews stay, including the author's first and last name and the company name. If that person is the only user of an active company, or of a company still under review, the company no longer has an active account and stays in the registry without a confirmed company ID. A suspended company stays suspended. Records the law requires may remain in archive.

16. Applicable law and jurisdiction

Mandatory consumer rights that cannot be contractually excluded apply to consumers. For business users, the law of Bosnia and Herzegovina applies, unless binding EU or member state regulations for consumers require otherwise. For disputes relating to these terms, the court in Sarajevo has jurisdiction, unless stronger mandatory regulations provide otherwise.

17. Contact

For legal questions, personal data requests and support use contact@cargotrust.co. We respond to GDPR requests within a reasonable period prescribed by law.
